33. Forms of land tenure according to the Council Code of 1649

First of all, in the Cathedral Code of 1649, it received consolidation право феодальной собственности на землю. Законодатель выделил в отдельные главы вопрос о поместных и вотчинных землях. Помещики имели только правомочия владения и пользования в отношении своих поместий.

1) the nature of the subject: дворцовые, государственные, церковные, частновладельческие.

2) acquisition method: родовые, выслуженные и вотчинные. Причем статус родовых и выслуженных вотчин отличался от статуса купленных. Так, после смерти вотчинника родовые и выслуженные вотчины наследовались его сыновьями, дочерьми и родственниками, жена же покойного получала на прожиток только из купленных вотчин, лишь за неимением их ей назначалась часть их родовых и выслуженных в пожизненное владение или пока вдова не выйдет замуж. Для выкупа проданной, выменянной или заложенной родовой вотчины устанавливалось право родового выкупа, которое действовало в течение 40 лет (на купленные вотчины оно не распространялось). Уложение запрещало продавать, закладывать или отдавать на помин души вотчины монастырям и церкви. Помимо этого, если вотчинник уходил сам в монастырь, он должен был перед этим продать или передать свои вотчины родственникам.

Родовой выкуп технически осуществлялся одним лицом, от имени рода в целом, а не выкупившего его лица. Цена выкупной сделки обычно совпадала с ценой продажи. Особое внимание уделялось регламентации круга лиц, допускавшихся к выкупу проданной или заложенной вотчины: отстранялись от выкупа нисходящие родственники продавца, а также боковые, принимавшие участие в сделке.

Subject of ownership на купленные вотчины была семья (муж и жена), этот вид вотчин приобретался супругами совместно на их общие средства. Следствием являлся переход вотчины после смерти одного из супругов к пережившему его. Однако после смерти владевшей купленной вотчиной вдовы право на вотчину переходило не в род умершей, а в род мужа, что указывало на принадлежность этой формы землевладения не отдельному супругу, а именно супружеской паре.

Первоначальным условием пользования поместьем являлась реальная служба, которая начиналась для дворян с пятнадцати лет. По отношению к уже сложившемуся поместью складывалась презумпция, согласно которой наделенный землей должен был относиться к ней как к собственной, с чем связывались и его ориентации в сферах эксплуатации и распоряжения поместьем. Отметим, что в системе хозяйственных отношений поместье ничем не выделялось из ряда других хозяйственно-правовых форм, что являлось тенденцией к их сближению.

1) personal easements - ограничение в пользу определенных лиц, специально оговоренных в законе (например, потрава лугов ратниками, находящимися на службе, право на их въезд в лесные угодья, принадлежащие частному лицу);

2) servitudes in rem - ограничение права собственности в интересах неопределенного числа субъектов (например, возможность возводить печь у стены соседского дома или строить дом на межи соседского участка).

Canadian company Spheral Solar has developed flexible solar cells, a denim-like material that can generate electricity when exposed to sunlight.

This material can be placed on a surface of any shape, not necessarily flat. The efficiency of batteries made from this material is 11%, which is comparable to the efficiency of conventional flat solar cells, and much better than their flexible variants based on conductive polymers.
