37. Public and religious organizations

Public and religious organizations относятся к некоммерческим организациям, участниками которых являются только физические лица. Являясь участниками общественных и религиозных организаций, граждане не получают никакого материального дохода или прибыли. Такие организации создаются с целью удовлетворения духовных потребностей их участников. Жертвуя какие-либо материальные средства в пользу организации, ее участники не могут потребовать их обратно в случае выхода из нее, а также не имеют права на распределение остатка имущества при ликвидации организации. Участники общественных и религиозных организаций избавлены от ответственности по долгам этих организаций, как и организации не отвечают за долги своих участников. Доходы, полученные в процессе деятельности общественных и религиозных организаций, поступают на нужды их учредителей.

Общественные и религиозные организации имеют свои уставы и законы, в которых должны быть четко решены имущественные вопросы в соответствии с целями, стоящими перед этими организациями.

Общественные организации - это объединения, созданные физическими лицами количеством не менее десяти человек на основе общих интересов. Целями для создания общественных организаций могут являться: защита прав граждан (социальных, гражданских, политических, культурных и других), участие в благотворительных мероприятиях, спортивных соревнованиях, в управлении государственными делами, развитии культуры, оздоровительных программах, мероприятиях по охране природы и другой общественно полезной деятельности. При создании общественных организаций созывается общее собрание, на котором участниками будущей организации избирается руководство, а также принимаются учредительные документы (устав или положения).

Доходы, получаемые в процессе деятельности организации, идут на осуществление поставленных перед ней целей.

Общественными организациями могут быть различные политические, детские, молодежные, спортивные, культурно-просветительские организации, творческие ассоциации, организации инвалидов, благотворительные организации и другие объединения.

Religious organizations - это добровольные объединения физических лиц, достигших совершеннолетнего возраста, в целях вероисповедания, совершения различных религиозных обрядов, богослужений, проведения проповедей, религиозного воспитания и религиозного просвещения.

Религиозные организации имеют свои учредительные документы в виде уставов и положений.

К религиозным организациям относятся религиозные учреждения, центры, духовные семинарии, религиозные объединения (местные, центральные, региональные).
