LECTURE No. 29. Exchange transactions

Биржевые сделки - все сделки, заключенные на бирже. Биржевой сделкой является зарегистрированный биржевой договор (соглашение), заключаемый участниками биржевой торговли во время торговой сессии в отношении биржевого товара, прошедшего биржевой листинг. Биржевые сделки не могут совершаться от имени и за счет биржи. Гарантии биржи не распространяются на сделки, совершенные на бирже, но не соответствующие требованиям для заключения данных сделок, так как эти сделки не являются биржевыми. Биржа может применить санкции к участникам биржевой торговли, совершающим внебиржевые сделки на данной бирже. Порядок регистрации и оформления биржевых сделок устанавливается биржей.

Exchange transactions have their own characteristics:

1) cannot be performed on behalf of and at the expense of the stock exchange;

2) сделки, совершенные на бирже, но не соответствующие требованиям для заключения данных сделок, не являются биржевыми;

3) биржа вправе применить санкции к участникам биржевой торговли, совершающим внебиржевые сделки на данной бирже;

4) the procedure for registration and registration of exchange transactions is established by the exchange.

Transactions concluded on the stock exchange are divided into:

1) сделки организационного характера. Заключаются на бирже и с участием биржи, они не связаны с переходом прав и обязанностей на биржевой товар, к ним относят договоры между биржей и брокерами, дилерами;

2) непосредственно связанные с биржевой торговлей по поводу биржевых товаров между брокерами и дилерами.

Для биржевой сделки характерными чертами являются срок, время и товар. Под сроком биржевой сделки понимается срок исполнения заключенной биржевой сделки. Под временем понимается время начала и оказания биржевых торгов, т. е. время, в течение которого стороны подают заявки на участие.

Биржевой товар - не изъятый из оборота товар определенного рода и качества, в том числе стандартный контракт и коносамент на указанный товар, допущенный в установленном порядке биржей к биржевой торговле. В качестве биржевых товаров не могут выступать недвижимое имущество и объекты интеллектуальной собственности (ст. 6 Закона РФ "О товарных биржах и биржевой торговле").

Depending on the duration of the contract, we can distinguish:

1) cash exchange transactions (with an immediate term for the execution of the contract);

2) срочные биржевые сделки. Момент заключения сделки и момент ее исполнения не совпадают; особенность срочных сделок - взаиморасчеты, происходящие между сторонами, и договорное исполнение разницы между договорной ценой и ценой, установленной биржей на день исполнения обязательства;

3) комбинированные биржевые сделки, сочетающие два предыдущих вида (допускают возможность включения в данный пункт условия поставки товара по возможной цене в будущем).

The main types of transactions on the exchange are:

1) форвардные сделки, при которых происходит взаимная передача прав и обязанностей в отношении реального товара с отсроченным сроком его поставки;

2) фьючерсные сделки, при которых происходит взаимная передача прав и обязанностей в отношении стандартных контрактов на поставку биржевого товара;

3) опционные сделки, когда производится уступка прав на будущую передачу прав и обязанностей в отношении биржевого товара или контракта на поставку биржевого товара;

4) обычные торговые сделки, когда взаимно передаются права и обязанности в отношении реального товара;

5) другие сделки в отношении биржевого товара, контрактов или прав, установленные в Правилах биржевой торговли.

Сделки на бирже могут осуществляться в отношении не любого товара, а только товара, который может быть разрешен законодательством и документами биржи к продаже, - биржевого товара.

Seal in touch 13.12.2002

Unlike the hero of the "Telephone" Chukovsky, the staff of the University of St. Andrew (Scotland) are happy when another seal calls them. They glue miniature radio beacons provided by the German company Siemens to the fur of newborn seals.

The device, which works through the cellular telephony network, from time to time sends messages about the activity of the seal to the university computer. If there are no messages for several days, the animal is considered dead.

Of the approximately 38 gray seals born every November in colonies of these mammals on the coast of Britain, only half survive to their first birthday, but there is no exact data yet. In the future, scientists intend to add a depth gauge and a positioning device to a simple motion sensor in radio beacons in order to accurately record migration routes and the depth at which animals hunt.

The device stays on the skin of a seal for no more than a year and disappears during the next molt.
