I. General Provisions

An economist-claimant is appointed and dismissed from his post, in accordance with the current labor legislation of Ukraine, by order of the Chief Executive Officer of the Company on the proposal of the Head of the Legal Department.
In the performance of his official duties (functions), he reports directly to the Head of the Legal Department.
In his work, the claims economist is guided by:

current legislation of Ukraine and international law;
Regulations on the legal department;
the Articles of Association of the Society;
internal labor regulations;
orders and instructions of the Chief Executive Officer of the Company;
this Job Description.

The Claims Economist must know:

resolutions, orders, orders, other governing and regulatory documents of higher and other bodies relating to legal activities;
current legislation of Ukraine;
current civil, labor, financial, administrative, economic law;
technical means of mechanization and automation (computer equipment) for reference and information work on legislation and regulations, office equipment, be able to work on them;
the procedure for keeping records and compiling reports on the claim work of the Company;
the procedure for agreeing, concluding and formalizing business contracts;
fundamentals of economics, organization of labor and management;
internal labor regulations and the Collective Agreement of the Company;
rules and norms of labor protection, safety measures, industrial sanitation and fire protection.

Qualification requirements: a person with a higher economic education is appointed to the position of an economist-claimant.

II. Official duties

Claims economist:

Develops or takes part in the development of internal documents of a legal nature in the Company.
Conducts economic and legal expertise of draft orders issued by the Company.
Prepares, with the participation of interested departments, services, structural divisions of the Company, materials on theft, embezzlement, shortages and other offenses for their transfer to the investigating authorities, courts of general and special jurisdiction.
Produces registration, conduct of cases in courts of general jurisdiction and magistrates' courts under a power of attorney from the Company, carries out their accounting and storage.
Participates in the development and implementation of measures to strengthen contractual, financial and labor discipline, ensure the safety of the Company's property.
Takes part in the work on the conclusion of business agreements (contracts), preparation of their legal validity, produces their sighting.
Participates in the consideration of issues related to the elimination of accounts receivable together with the departments concerned.
Maintains the established reporting on claims and other work of the Company.
Analyzes and summarizes the results of consideration of claims and court cases of general and special jurisdiction, as well as studies the practice of concluding and executing economic agreements (contracts) in order to develop appropriate proposals for eliminating identified shortcomings and improving the economic and financial activities of the Company.
Controls the timeliness of submission of references, calculations, explanations and other materials for the preparation of responses to claims and lawsuits of counterparties.
Conducts reference and information work on legislation and regulations using computer technology, as well as accounting for current legislation and other regulations.
Carries out work on legal propaganda, familiarization of the Company's officials with the regulations related to their activities, and about changes in the current legislation.
Provides information and consultations to the employees of the Company, its shareholders on the current legislation, and also draws conclusions on legal issues, assists them in the preparation of documents and acts of a property-legal nature.
In case of temporary absence from work of one of the employees of the legal department (with the exception of the head of the department), performs their duties.

III. Rights

The claims economist has the right to:

Request and control the timeliness of submission to the legal department of the Company from its divisions (departments, services) of certificates, calculations, conclusions, explanations and other materials necessary for the preparation of claims and claims against the Company's counterparties, as well as for preparing responses to them;
Check compliance with the current legislation and local regulations in the structural divisions of the Company;
By proxy of the Company, represent its interests in all state and non-state enterprises, institutions, organizations (commercial and non-commercial), regardless of their organizational and legal form.

IV. A responsibility

The claims economist bears disciplinary and financial responsibility to the Company for:

Non-fulfillment or improper fulfillment of the "Internal Labor Regulations", their official duties provided for by this instruction, orders and orders of the Company's management within the limits determined by the current labor legislation;
Material damage caused to the Company through its fault;
Other violations and misdemeanors in accordance with the current legislation of Ukraine and internal regulations of the Company.
