Compulsory industrial accident insurance is a special type of state insurance that guarantees the property interests of the employee and the employer in cases. when, despite preventive labor protection measures, the worker's ability to work has suffered from a special group of reasons.

Insurance - this is the creation at the expense of the funds of organizations and citizens of special reserve funds (insurance funds) intended to compensate for harm, losses caused by adverse events. Accidents. In recent years, due to unprofitability, bankruptcies and the liquidation of a large number of organizations, violations of the legislation on compensation for harm to health have increased dramatically. This is a delay, reduction or termination of payments of amounts of compensation for harm, incorrect calculation of the amount of compensation, etc.

The main normative act regulating the issues of insurance against accidents at work is the Federal Law of July 24, 1998 No. 125-FZ "On Compulsory Social Insurance against Industrial Accidents and Occupational Diseases".

Insurance against accidents at work and occupational diseases by virtue of special legislation designed to provide:

  • compensation for harm caused to the life and health of an employee in the performance and by him of his labor duties and in other established cases;
  • social protection of insured persons;
  • economic interests of subjects of insurance;
  • stimulation of activities to improve labor protection:
  • provision of preventive measures to reduce industrial injuries and occupational diseases.

You should be aware that compensation for harm is carried out by providing full types of insurance coverage (in monetary amounts). They are divided into basic and additional.

All those who have lost their ability to work due to accidents at work are entitled to basic payments: temporary disability benefits (in the amount of average earnings); insurance payments (one-time and monthly).

Additional security involves payment of expenses for medical, social and professional rehabilitation of the employee, the need for which is determined by the institution of medical and social expertise that examined the victim.

It should be noted that the guilt of the victim in the form of gross negligence may affect the reduction (up to 25%) of the monthly payment.
