Dismissal for violation in the field of labor protection. Occupational Safety and Health

Occupational Safety and Health

Occupational Safety and Health / Legislative basis for labor protection

Comments on the article Comments on the article

For violation of the legislation on labor protection, officials of the employer may be subject to disciplinary, material, administrative or criminal liability.

Violation may be expressed in the actions or inaction of an official aimed at violating or non-compliance with the current legislation on labor protection. Administrative responsibility in the form of a fine in the amount established by Article 5.27 of the Code of Administrative Offenses of the Russian Federation is brought to bear on an employer (an official - the head of an organization, regardless of the legal form and form of ownership), an individual entrepreneur.

If state inspectors conduct an inspection and repeatedly reveal violations of labor legislation in the field of labor protection, then the violator will be punished in the form of disqualification for a period of one to three years.

Consideration of cases of disqualification, i.e. deprivation of the right to hold the specified position for a certain time, is accepted only by the court. Therefore, the inspector prepares the relevant documents and submits the case to the court.

Any person who had the obligation to comply with these rules may be held criminally liable for violation of safety rules or other labor protection rules, if this negligently entailed the infliction of severe or moderate harm to human health. In this case, the act is punishable by a fine in the amount determined by part 1 of article 143 of the Criminal Code of the Russian Federation.

However, if a violation of safety regulations or other labor protection rules negligently caused the death of a person, then the guilty person is held liable in the form of imprisonment with deprivation of the right to occupy certain positions or engage in certain activities. Violation of labor protection rules in such cases can also be expressed both in the form of action and inaction. However, this offense is characterized by guilt in the form of negligence.

Accordingly, after the decision of the court on the deprivation of the right to hold certain positions, the guilty person must be dismissed from the enterprise.

An employer may dismiss an employee for systematic failure to fulfill his duties, including failure to comply with job descriptions and safety instructions. In this case, the employer first imposes a disciplinary sanction on the negligent employee, and then, if violations are repeated, it also applies dismissal, in accordance with the Labor Code.

Artificial leather for touch emulation 15.04.2024

In a modern technology world where distance is becoming increasingly commonplace, maintaining connection and a sense of closeness is important. Recent developments in artificial skin by German scientists from Saarland University represent a new era in virtual interactions. German researchers from Saarland University have developed ultra-thin films that can transmit the sensation of touch over a distance. This cutting-edge technology provides new opportunities for virtual communication, especially for those who find themselves far from their loved ones. The ultra-thin films developed by the researchers, just 50 micrometers thick, can be integrated into textiles and worn like a second skin. These films act as sensors that recognize tactile signals from mom or dad, and as actuators that transmit these movements to the baby. Parents' touch to the fabric activates sensors that react to pressure and deform the ultra-thin film. This ... >>

The attractiveness of caring men 14.04.2024

The stereotype that women prefer "bad boys" has long been widespread. However, recent research conducted by British scientists from Monash University offers a new perspective on this issue. They looked at how women responded to men's emotional responsibility and willingness to help others. The study's findings could change our understanding of what makes men attractive to women. A study conducted by scientists from Monash University leads to new findings about men's attractiveness to women. In the experiment, women were shown photographs of men with brief stories about their behavior in various situations, including their reaction to an encounter with a homeless person. Some of the men ignored the homeless man, while others helped him, such as buying him food. A study found that men who showed empathy and kindness were more attractive to women compared to men who showed empathy and kindness. ... >>

Recharging with light 11.01.2000

A small device - a heart stimulator transplanted under the skin - saved the lives of many, but every few years the operation has to be repeated in order to change a dead battery. Osaka University (Japan) is experimenting with a stimulator recharged by light.

A solar battery is introduced under the skin - a thin plate measuring two by two centimeters. By illuminating it with a laser beam for two hours, you can recharge the stimulator for 22 hours of operation. The laser is infrared, with a wavelength of 860 nanometers: this invisible light penetrates the skin well. The laser power is 30 percent of the permissible sanitary standards for human exposure.

About 200 people in Japan wear pacemakers. Heart disease is getting younger, more and more middle-aged Japanese have to connect a stimulator, which means that throughout life they will either have to undergo operations with changing the battery many times, or find a way to recharge it.
