46. CONTRACT FOR THE PERFORMANCE OF DESIGN AND SURVEY WORKS

Contract for the performance of design and survey work - this is an agreement by virtue of which the contractor (designer, prospector) undertakes, on the instructions of the customer, to develop technical documentation and (or) perform survey work, and the customer undertakes to accept and pay for their result (Article 758 of the Civil Code of the Russian Federation). In most cases, capital construction should be preceded by survey and design work.

The contract for the performance of design survey work is:

1) consensual - the conclusion of the contract occurs from the moment the parties reach an agreement on its terms;

2) paid;

3) mutual - the existence of subjective rights and obligations of both parties to the contract for the performance of design and survey work.

subject of a contract - design work or survey work, or both design and survey work. Carrying out survey and design work is a necessary prerequisite for the implementation of capital construction.

survey work are aimed at obtaining materials about the conditions of future construction and the operating conditions of the facility to be built. Engineering surveys are divided into basic and special.

Design work include the preparation of design documentation for the construction or reconstruction of a capital construction facility, as well as major repairs, if during its implementation the design and other characteristics of the reliability and safety of capital construction facilities are affected.

Parties to the contract

▪ the contractor, who acts respectively as a designer or surveyor, and the customer. Carrying out survey and design work requires special knowledge and skills, therefore, on the side of the contractor, as a rule, specialized organizations or citizens with the appropriate license act. The customer can be any person.

Form of contract

▪ written.

The contractor is obliged:

1) perform work in strict accordance with the task, other initial data, the contract and established regulatory requirements;

2) coordinate the finished technical documentation with the customer;

3) transfer to the customer, according to the acceptance certificate, the finished technical documentation and the results of survey work.

The customer must:

1) pay for the work, as well as reimburse the contractor for additional expenses that are caused by a change in the initial data due to circumstances beyond the control of the contractor;

2) assist the contractor in the performance of work to the extent and on the terms stipulated by the contract.

Latest news of science and technology, new electronics:

The existence of an entropy rule for quantum entanglement has been proven 09.05.2024

Quantum mechanics continues to amaze us with its mysterious phenomena and unexpected discoveries. Recently, Bartosz Regula from the RIKEN Center for Quantum Computing and Ludovico Lamy from the University of Amsterdam presented a new discovery that concerns quantum entanglement and its relation to entropy. Quantum entanglement plays an important role in modern quantum information science and technology. However, the complexity of its structure makes understanding and managing it challenging. Regulus and Lamy's discovery shows that quantum entanglement follows an entropy rule similar to that for classical systems. This discovery opens new perspectives in the field of quantum information science and technology, deepening our understanding of quantum entanglement and its connection to thermodynamics. The results of the study indicate the possibility of reversibility of entanglement transformations, which could greatly simplify their use in various quantum technologies. Opening a new rule ... >>

With it, users can enjoy coolness anytime, anywhere by simply wearing it around their neck. This mini air conditioner is equipped with automatic adjustment of operating modes, as well as temperature and humidity sensors. Thanks to innovative technologies, Reon Pocket 5 adjusts its operation depending on the user's activity and environmental conditions. Users can easily adjust the temperature using a dedicated mobile app connected via Bluetooth. Additionally, specially designed T-shirts and shorts are available for convenience, to which a mini air conditioner can be attached. The device can oh ... >>

Energy from space for Starship 08.05.2024

Producing solar energy in space is becoming more feasible with the advent of new technologies and the development of space programs. The head of the startup Virtus Solis shared his vision of using SpaceX's Starship to create orbital power plants capable of powering the Earth. Startup Virtus Solis has unveiled an ambitious project to create orbital power plants using SpaceX's Starship. This idea could significantly change the field of solar energy production, making it more accessible and cheaper. The core of the startup's plan is to reduce the cost of launching satellites into space using Starship. This technological breakthrough is expected to make solar energy production in space more competitive with traditional energy sources. Virtual Solis plans to build large photovoltaic panels in orbit, using Starship to deliver the necessary equipment. However, one of the key challenges ... >>

neurons of loneliness 24.02.2016

Loneliness affects the cellular structure of the brain, strengthening the connections between certain neurons and causing them to react violently to social contacts.

While studying the effect of drugs on dopamine neurons in mice, Gillian Matthews and her colleagues noticed that in animals that sat in isolation for 24 hours, interneuronal connections increased in the so-called dorsal raphe nucleus, and increased connections occurred in those mice. who did not receive any drugs. (The nuclei of the suture are clusters of neurons located in the midline of the medulla oblongata, they are divided into several groups according to their structure and functions, but in general this area of \uXNUMXb\uXNUMXbthe brain has not been studied very well.)

Further experiments confirmed that the cells of the dorsal nucleus do indeed respond to the lack of communication - it is known that strengthening of connections, strengthening of interneuronal synapses occurs when the nerve chain is active, when a signal runs along it, and strengthening of synapses during loneliness indicated that local neurons respond to social isolation.

However, there was one feature in their behavior: if the mouse was kept together with comrades, then the neurons of the nucleus did not work very hard, but if the mouse moved from a solitary cell to a company, then the activity of the neural circuits of the dorsal nucleus increased sharply, although not for long.

In other words, neurons seemed to become more sensitive to social cues during isolation. This was also manifested in behavior: the mice released from the "loners" were more sociable than those that did not sit there. If the activity of nerve cells was suppressed artificially, then the animals did not show any burst of social activity.

Curiously, the behavioral response accompanying changes in the functioning of neurons in the dorsal raphe nucleus also depended on the social status of the mouse itself: those who occupied a higher position in the group began to communicate especially strongly after a period of forced loneliness. In general, everything is like with people: among Homo sapiens, the most popular "individuals" also do not think of themselves outside of society, well, and those who are not very popular generally sometimes prefer to stay in some deserted place - all the worries are less.
