Chapter 9 Spy things Smuggling (Italian contrabando, from contra - against and bando - government decree) is the secret transportation or transfer of goods and valuables across the state border, hiding them from customs control. Goods smuggled or smuggled across the border are often referred to as smuggling. In many states, cases of smuggling are considered by criminal law as one of the types of violation of the monopoly of foreign trade. In the Criminal Code of the Russian Federation, article 188 is devoted to smuggling, which states: 1. Smuggling, i.e. moving on a large scale (i.e. if the value of the transferred goods exceeds two hundred times the minimum wage) across the customs border of the Russian Federation of goods or other items, with the exception of those specified in part two of this article, committed in addition to or with concealment from customs control or with the fraudulent use of documents or means of customs identification, or associated with non-declaration or false declaration, is punishable by imprisonment for a term of up to five years. The philosophy of smuggling and the dangers associated with it is worth thinking about, as many people start this criminal activity without thinking about the consequences. "Who am i?" is the first question to ask yourself. Some, such as those who often travel abroad, have special advantages for smuggling. For example, it is not difficult for airline employees to smuggle something illegal. A good example is the sensational case of Eastern Airlines. The drug smuggling system organized by the Colombians operated for several years with the participation of employees of this company. There is nothing surprising here. In civilian aircraft, there are many places where you can hide whole kilograms of drugs. Aircrew regularly pass through customs, and it is only natural that customs officers do not inspect these people as diligently as other passengers. When servicing an aircraft on the airfield, ground employees have access to it, so that contraband can be carried past customs at all. Of course, this requires the consent of ground workers, but as the case of "Estern Airlines" showed, it is not so difficult to obtain. If you have the air of a positive, respectable person, it will be much easier for you to get through customs than a ragamuffin hairy man. The servants of the law are no smarter than the rest, they have the same limited views and they are just as prone to stereotypes. Customs officers will pounce on some hippie, but a neat, solid man in a three-piece suit will not be pestered, even if he falls under suspicion, interrogation begins with polite questions, and not with rude shouts that fall to the lot of less respectable personalities. So, we see that a certain status gives some protection, and people of certain professions may not be as strict with the law as others. Law enforcement officials enjoy some immunity. But they can not be compared with customs officers. We do not want to cast a shadow on the bright image of the Russian customs officer. However, as they say, in any flock there is a black sheep. But we very rarely hear that a customs officer was arrested for smuggling. They just don't come across. The fact is that customs officers are very well protected from exposure. The customs officer does not need to carry the contraband himself. It is enough for him to cooperate with the smuggler and "turn away" when he crosses the border. Diplomats have a very special status. According to the Vienna Agreement, a person with a diplomatic passport is not subject to search, detention and arrest. In practice, a diplomatic passport is a "license to kill." Diplomats regularly smuggle either for themselves or for their country. This is not difficult, as customs officers are not allowed to open their luggage and even ask if they want to put anything on the declaration. Spy equipment is regularly smuggled in "diplomatic pouch". These are not necessarily briefcases or bags, quite often it is a huge box or chest. There can be anything, literally anything: weapons, drugs, and even the human body. Twenty-five years ago, Egyptian diplomats tried to smuggle an anesthetic spy out of Italy in a diplomatic chest. However, the anesthesia was not very strong, the spy came to life, made a fuss at the Fiumicino airport and managed to attract the attention of the Italian customs officer, who put an end to the operation. The population of the border regions also has a special status, although it is purely unofficial. They are well aware of the topography of their native places, and many families have been smuggling for generations. For example, in the Pyrenees, locals have been smuggling for centuries, regularly violating the border between France and Spain. 9.1. Helpers There are two ways to use the services of others to smuggle: with or without their knowledge. You can ask someone to carry a bundle for you across the border; it can be risky, but not always. At some borders, there are strict currency controls: you can not export the currency, the amount of which exceeds a certain limit. If you divide a large amount for two, everything will be "within the law." Some contraband items, say cocaine, are never legal under any circumstances, so if you ask someone to smuggle cocaine across the border, you put them at risk. You can't ask a friend for this. This brings us to the idea of unwitting helpers. You can put contraband in someone else's luggage. To do this, it is enough, say, to change the name tags on similar suitcases. Another way is to slowly slip the contraband into a woman's purse. To get it back, you just need to play an "accident": someone runs into her, and the contents of the purse scatter on the floor. Another method is often used - they attach a container with smuggled goods to a car that regularly travels across the border. It could be a traveling salesman or a delivery van. The main thing is that the border guards do not check it very carefully every time they cross the border. The box of goods can be attached to the magnet behind the bumper or on the chassis when the driver stops for coffee. Then the smuggler will follow him across the border and there, at the next stop of the car, he will remove the box. Smugglers need to take into account the peculiarities and cultural traditions of the countries where they go, so as not to inadvertently draw attention to themselves. For example, in Spain, magazines like Playboy or Hustler are considered hardcore pornography. If this policy has not changed by the time this book goes out of print, do not take these magazines with you: they will be confiscated from you at the border. Moreover, you will attract the attention of the customs officers, and they may search all your luggage to see if there is anything else that is not subject to import. In some places, a camera may bring suspicion on you. If you find yourself near any military organization, be careful. A camera dangled quite innocently around your neck is sure to draw attention to you and your luggage. 9.2. Psychology Smuggling is not an easy emotional test. You may feel your breathing difficult and heart racing, especially when the moment of truth comes and you have to look the customs officer in the eye and declare that you "have nothing to declare." One expert in this field advises to rehearse: first cross the border several times without smuggling, for training, to overcome the feeling of anxiety. And this is understandable - if you go through a stressful situation several times without any consequences, anxiety will dull. Passing through customs and talking to border guards when you have nothing to fear, you will develop self-confidence and a certain demeanor, which you could not do if you were constantly afraid that some zealous law enforcement officer would start rummaging through your luggage and find there smuggling. Such training complicates their cost. If, when crossing the border, you drive only a few miles from your home, as, for example, in Kaliningrad or Brest, then there are no problems here. If you have to cross the ocean, it will be quite expensive. Another way, which will cost nothing, is to rehearse in your mind. If you mentally go through customs a few times, you can make a plan on how to behave and how to answer questions. In addition, it will help to release from the grip of anxiety. The use of psychology also helps, unless, of course, you are under suspicion from the very beginning. Suppose you need to carry something in your luggage. Try to hide it in an object that seems to be one-piece. It is psychologically much more difficult for a customs officer to break or break such a solid object than to open something that opens easily. For example, it will be much more reliable to hide a small object in a league figurine than in the battery compartment of a receiver. But such reliability is limited. If the customs officers have reason to suspect you, if someone gave them a "tip", then they will take you to a separate room and show you how they know how to search Customs officers are the only ones who have the right to search without a warrant During a search, they can disassemble your luggage into small pieces. Cutting through the lining of every suitcase is not considered a last resort by them, just like opening any item you are carrying. After all, contraband can be hidden, for example, in a tube of shaving cream or in a camera. In some countries, you may be asked to strip naked, and customs officers will feel all your clothes, seam by seam, centimeter by centimeter. They can carefully examine your body: comb your hair, look into your mouth and ears, and even, wearing a rubber glove, check your rectum. 9.3. Betrayal One of the important rules that should be strictly observed when traveling: if you are asked to carry something, do not take anything from anyone. This topic has been played out in so many films that a child can understand why this should not be done. are always obvious, let's take a quick look at them: 1. The smuggler is trying to get you to risk instead of himself. You are smuggling, and he rides next to you or flies on the next flight. If you get caught, then the bag is in your hands, not in his. 2. The spy needs to smuggle something across the border, but he cannot do it himself, as he is already known to the authorities. And you, an unsuspecting traveler, are quite a suitable candidate for this. If you don't believe me, check out some old Alfred Hitchcock films. 3. The person who asks you to help him may be an agent provocateur who works in law enforcement. Or maybe this is a customs officer who has not had enough detentions this month, and he wants to improve his statistics or rehabilitate himself in the eyes of his superiors. The easiest way to do this is by "substituting" the innocent. If you're really a smuggler, you need to be especially observant of the people you're dealing with. After all, as you know, there are no "honest thieves". Many of them are scoundrels to the core. The only thing that makes them more or less honest with their fellows is the fear of consequences. A smuggler-informant every month gives the police a certain number of people "working" on their own. He gets his main profit in his gang, which he does not dare to report, knowing that very soon after that his corpse will float on the river or lie in some deserted place. And a lone smuggler, if he is arrested, will not be able to take revenge, so it’s better to give out such people. 9.4 Money When contemplating whether or not to engage in smuggling, one more aspect is often forgotten: you have to pay for smuggling. Transporting goods is the second half of the job. The first is to send money across the border to pay for it. Americans, when leaving their country, as a rule, are not subjected to strict customs inspection. They can safely carry a suitcase full of banknotes and not worry about it on this side of the border. But on the other side, things can be more complicated. Everything depends on the country. British and French customs usually let Americans pass without unnecessary delay if they say they have nothing to declare. However, in the UK, an Irish surname or accent can draw attention to you, no matter what nationality is listed on your passport. The procedure for moving money across the border of our country is regulated by the relevant documents of the customs legislation of Russia. The basic rules for the import and export of funds are as follows. The basis for the export by individuals from the Russian Federation of foreign currency in cash and payment documents in foreign currency (traveler's checks, personal checks and cash letters of credit) is the Certificate f. No. 0406007. The certificate is issued by authorized banks when performing currency exchange transactions and is valid for two years from the date of issue. Only the currency of the name specified in the Certificate is allowed for export. Export of other currency, in the amount equivalent to that indicated in the certificate (in translation), is prohibited. Foreign currency and payment documents in foreign currency previously imported into the Russian Federation and included in the customs declaration may be exported abroad on the basis of the entry customs declaration. The entry customs declaration is valid for 12 months from the date of issue. When importing foreign currency and payment documents in foreign currency into the Russian Federation, instead of a customs declaration, a customs officer may issue a Certificate of form TS-28. Export abroad of the currency values specified in the Certificate is allowed within 2 years The right to export foreign currency is granted only to the person in whose name the relevant documents are drawn up (Certificate f. No. 0406007, customs declaration. Certificate f. TS-28). Without permits, you can export foreign currency in the amount of up to 500 US dollars inclusive, calculated using the exchange rate on the date of crossing the border. The specified currency is subject to entering into the V section of the declaration and presentation for customs control. Import of foreign currency and payment documents in foreign currency is carried out without restrictions. Information about them must be included in the customs declaration. Only lone smugglers have to worry about transporting money across the border. Large organizations have other methods: for example, they create front companies that transfer money electronically through legal banks. You can pay not with money, but with precious stones. They are much easier to transport across the border, as they take up very little space: a tube of toothpaste will fit a million dollars worth of diamonds. 9.5. Smuggling for fun It's one thing to smuggle an extra bottle of vodka duty-free, but to smuggle a decent load of drugs is quite another. As we have seen, the main calculation of the smuggler is based on not very careful customs inspection. Although the customs officers are instructed to thoroughly search everyone who crosses the border, in reality they cannot do this - otherwise the process of crossing the border would drag on for several days. Instead, customs officers rely on spot checks, their intuition, and intelligence from a network of whistleblowers. If you are going to smuggle something across the border, seriously consider how worth the risk is. For small violations, the risk is small. An undeclared camera or your own jewelry are the same things as an extra bottle of alcohol. Customs officials are interested in collecting fees, not spending public money sending people to jail for minor infractions. If you are involved in serious smuggling, then the main danger comes from informants, and not from ordinary customs inspection. You can hide the contraband well enough that it won't show up on a surface search, but if you've been tipped off by an informant, you won't be able to avoid exposure and arrest.
