I. General Provisions

  1. A person who has a higher professional (technical) education, additional legal training and work experience in the field of claims work at least (1 year; 2 years; 3 years) is appointed to the position of a specialist in claim work.
  2. The Claims Specialist must know:
  • rules for the carriage of goods by various modes of transport;
  • technical conditions for loading, unloading and securing cargo;
  • state standards for goods to be transported;
  • the procedure for drawing up claims and acts for the carriage of goods;
  • procedure for consideration and settlement of claims;
  • the procedure for transferring goods to other carriers;
  • rules for the inspection of vehicles and rolling stock;
  • instructions for the production of loading and unloading operations;
  • standards for the conditions of transportation and packaging of goods;
  • the procedure for unloading, receiving, storing, issuing and servicing cargo along the way;
  • the procedure for issuing transportation documents;
  • requirements for the preparation of commercial acts;
  • terms of delivery of goods and the rules for calculating the terms of delivery.
  • norms of natural loss of goods during transportation by various modes of transport;
  • methods of packaging and stowage of goods in vehicles, containers;
  • nomenclature of transported goods, methods of their transportation depending on the season;
  • technical norms for loading vehicles;
  • reporting and accounting documentation for the transportation of goods;
  • fundamentals of the economy.
  1. Appointment to the position of a specialist in act-claim work and dismissal from office is carried out by order of the head of the transport organization.
  2. The Claims Specialist reports directly to _______.

II. Official duties

Litigation Specialist:

  1. Organizes the investigation of cases of non-safety of goods, untimely delivery of goods in accordance with the terms of the concluded contracts.
  2. If necessary, travels as a representative of a transport organization to participate in the preparation of commercial acts.
  3. Analyzes the acts and conclusions of the examination, commercial acts, other documents establishing the facts of theft, loss, shortage of goods to identify the perpetrators and determine the amount of damages.
  4. Examines the provisions of concluded contracts in order to establish violated conditions.
  5. Establishes the reasons for non-compliance with the terms of delivery of goods accepted for transportation.
  6. Establishes the causes of damage to goods (checks: compliance with the conditions of packaging, packing, loading, unloading, storage, transportation, etc.; the presence of warning labels).
  7. Based on the analysis of the situation with the safety of transported goods, compliance with the terms of delivery of goods, develops requirements for structural units to improve the organization and technological process of transportation.
  8. Prepares responses to counterparties' claims (on satisfaction, on refusal to satisfy).
  9. Prepares cases for settlements with consignors, consignees who have suffered material damage, as well as cases for transfer to arbitration courts.
  10. Draws up claims to consignees, consignors on the facts of delay in the transfer of goods for transportation, untimely acceptance of delivered goods, exceeding the norms of downtime of rolling stock under loading and unloading.
  11. Based on the data provided by the dispatch service and responsible employees, it keeps records of breakdowns and repairs of rolling stock, traffic accidents, other events and actions that caused damage to consignors, consignees.
  12. Advises employees responsible for drawing up documentation for the acceptance of goods on the requirements for transport documentation, the amount of information specified in the acts.
  13. Develops measures to ensure the safety of transported goods and improve the act and claim work in the organization.
  14. Carries out control over the satisfaction of reasonable requirements of consignors, consignees, other contractors.
  15. Carries out work to improve the technology of work on the investigation and consideration of commercial acts and claims.
  16. Keeps records of acts and claims, related documents in the form approved by the organization.

III. Rights

The Claims Specialist has the right to:

  1. Represent the transport organization on the issues of act and claim work in relations with consignors, consignees, other contractors.
  2. Act on behalf of the transport organization in arbitration courts.
  3. Get acquainted with the documents that define his rights and obligations in his position, the criteria for assessing the quality of performance of official duties.
  4. Sign and endorse documents within their competence.
  5. Require the management of the organization to provide the organizational and technical conditions necessary for the performance of official duties.

IV. A responsibility

The Complaint Specialist is responsible for:

  1. For improper performance or non-performance of their official duties provided for by this Job Description - within the limits established by the current labor legislation of Ukraine.
  2. For offenses committed in the course of their activities - within the limits established by the current administrative, criminal and civil legislation of Ukraine.
  3. For causing material damage to the organization - within the limits established by the current labor and civil legislation of Ukraine.

A few years ago, Polish paleontologist Grzegorz Niedzwiecki found footprints of an unknown creature on a rock in an abandoned quarry in southeastern Poland.

Recent measurements of the age of the minerals made it possible to establish that the rock on which the imprints remained is 395 million years old.
