Occupational Safety and Health Occupational Safety and Health / Legislative basis for labor protection Instructions - this is a local act of the employer, detailing the application of state regulatory requirements for labor protection, taking into account the specifics of specific working conditions, a specific workplace and specific types of work that are performed in this work set. The instruction is the main document on labor protection that employees must follow. The current Labor Code has made it the responsibility of the employer to develop and approve rules and instructions on labor protection for employees. In addition, the employer is obliged to ensure the availability of a set of regulatory legal acts containing labor protection requirements in accordance with the specifics of its activities. For the timeliness and correctness of development, approval, familiarization, revision, etc. instructions are answered by the head of the organization (division). The procedure for the development, coordination, approval, accounting, publication, distribution, cancellation of rules and instructions on labor protection is established by Resolution of the Ministry of Labor of Russia dated December 17, 2002 No. 80 “On approval of methodological recommendations for the development of state regulatory requirements for labor protection.” The list of necessary instructions is created on the basis of the staffing table in accordance with the “Unified Tariff and Qualification Directory of Work and Professions of Workers” and the “Qualification Directory of Positions of Managers, Specialists and Other Employees.” To give the list legal force, it is approved by the head of the organization. Labor safety instructions for employees are developed by the heads of the relevant structural divisions of the organization and approved by order of the employer, taking into account the opinion of the elected body of the primary trade union organization or other body authorized by employees in the manner established by Article 372 of the Labor Code for the adoption of local regulations. The labor protection service (labor safety specialist) of the organization monitors the timely development, verification, revision and approval of labor protection instructions for workers, and provides methodological assistance to developers. When developing the Instructions, they take as a basis the content of the interindustry or industry standard instructions on labor protection (and in its absence, interindustry or industry rules on labor protection), the safety requirements set out in the operational and repair documentation of equipment manufacturing organizations, as well as in the technological documentation of the organization taking into account specific production conditions. These requirements must be set out in relation to the employee’s profession or type of work performed. It should be remembered that using standard instructions makes the work easier. BUT!!! They cannot take into account the specifics of your particular workplace or type of work, often asking either too much or not asking for what you need. For newly commissioned and reconstructed production facilities, it is allowed to develop temporary instructions on labor protection. However, the word “Temporary” only means that these instructions will be revised soon and nothing more, because the purpose of any instructions is to ensure the safe conduct of work (technological processes), the safe operation of equipment and, in general, the safety of labor and production. The same requirements apply to the development of temporary instructions as to the preparation of permanent instructions. They are developed for the period until the specified production facilities are accepted into operation. Instructions for workers engaged in blasting operations, maintenance of electrical installations and devices, lifting machines, boiler plants, pressure vessels and for other workers whose occupational safety requirements are established in inter-industry and sectoral acts approved by federal bodies of state supervision and control are being developed on the basis of these acts and are approved in the manner established by these bodies. The employer organizes the verification and revision of labor safety instructions for employees. The instructions must be reviewed at least once every 5 years. Labor protection instructions are adjusted in the following cases:
If during the validity period of the labor protection instruction for an employee his working conditions have not changed, then by order (instruction) of the employer its validity is extended for 5 years by issuing a “Laboratory Safety Instruction Extension Sheet”, which is recorded on the first page of the instruction ( the current date is affixed, the stamp “Revised” and the signature of the person responsible for revising the instructions are given, the name of his position and the explanation of the signature are given, and the deadline for extending the instructions is indicated). The sheet is attached to the original instructions. Reworked and revised instructions are agreed upon and approved in the same manner as newly developed ones. The location of instructions posted at workplaces or areas or stored in another place accessible to employees is determined by the head of the unit. Each head of a workshop, department, section, or foreman must have a list of current instructions and a complete set of them for those working in all professions or types of work in the department he is managing; The manager should ensure their proper storage. Labor safety instructions for workers can be given to them (under signature on a personal briefing card) for study during the initial briefing, or posted at workplaces or areas, or must be stored in another place accessible to workers. The requirements of the instructions are mandatory. Failure to comply with these requirements should be considered a violation of internal labor regulations, employment contracts, and labor legislation. Accounting for labor protection instructions for workers is carried out by the labor protection service (labor safety specialist) of the organization.
