Occupational Safety and Health / Legislative basis for labor protection

The discipline of labor is the order of conduct established in a given organization of labor in joint work and responsibility for its violation.

When concluding an employment contract, the employee knows that in the process of labor he is obliged to obey the one-man manager in production during the period of validity of his employment contract, and this is the most important aspect of labor discipline, as a necessary element of the employee's employment relationship.

Labor discipline as one of the basic principles of labor law requires the employee to comply with the terms of the employment contract and conscientiously perform those labor duties for which he was hired.

At the same time, labor discipline is an appropriate institution of labor law, i.e. a system of legal norms regulating the internal labor regulations, which provides for the obligations of the employee and the employer (his administration), incentive measures for success in work, the procedure for their application, types and measures of responsibility for violation of labor discipline and the procedure for their application, which corresponds to Section VIII of the Labor Code of the Russian Federation (Articles 189 - 195).

Labor discipline, Art. 189 of the Labor Code of the Russian Federation is obligatory obedience for all employees to the rules of conduct defined in accordance with the Labor Code, other federal laws, a collective agreement, agreements, local regulations, an employment contract. The employer, in accordance with the specified legislation, is obliged to create the conditions necessary for the observance of labor discipline by employees.

The labor schedule is determined by the internal labor regulations that regulate, in accordance with labor legislation, the procedure for hiring and dismissing employees, the fundamental rights, duties and responsibilities of the parties to an employment contract, working hours, rest periods, employee incentives and penalties, as well as other issues of regulating labor relations in organizations (Article 189 of the Labor Code).

Work discipline is different objective и subjective sense.

В objective sense - this is a system of norms on labor discipline, i.e., the internal labor schedule established in this production.

В subjective - this is an element of the employee's labor relationship and his obligation to comply with the rules of internal labor regulations, labor discipline.

The employee is also obliged to comply with the job descriptions, functional duties provided for by the qualification guide for his position, work, as well as fire and sanitary instructions for this production. The employer (administration) is obliged to ensure the proper level of labor discipline in production and respond to its violation by individual employees.

Labor discipline in production includes the observance of technological and production discipline.

technological discipline - this is the observance of the manufacturing technology of the product of production, the technological process of its manufacture.

Production discipline - this is part of the labor discipline of administration officials who are obliged to organize the continuity of the technological process, the timeliness of the supply of materials, tools, equipment, the coordination of the work of individual production units in order to ensure the rhythmic, accurate work of the entire production.

The value of labor discipline lies in the fact that it:

contributes to the achievement of high quality results of the work of each employee and the entire production;
allows the employee to work with the highest productivity, which increases production efficiency;
contributes to the protection of health and life during work, the prevention of industrial injuries and occupational diseases;
contributes to the rational use of the working time of each employee and the entire workforce.

Methods for ensuring labor discipline are necessary to create organizational and economic conditions for high-performance work. The following three methods are interrelated: conscious attitude to work; methods of persuasion and education; encouragement for conscientious work, and for negligent, dishonest workers - the application, if necessary, of measures of disciplinary and social influence.

Computer games are becoming an increasingly popular form of entertainment among teenagers, but the associated risk of gaming addiction remains a significant problem. American scientists conducted a study to determine the main factors contributing to this addiction and offer recommendations for its prevention. Over the course of six years, 385 teenagers were followed to find out what factors may predispose them to gambling addiction. The results showed that 90% of study participants were not at risk of addiction, while 10% became gambling addicts. It turned out that the key factor in the onset of gambling addiction is a low level of prosocial behavior. Teenagers with a low level of prosocial behavior do not show interest in the help and support of others, which can lead to a loss of contact with the real world and a deepening dependence on virtual reality offered by computer games. Neurocomputer interface implanted in human 30.07.2022

The brain-computer interface has become a reality in the United States (albeit limited so far). Synchron says it has become the first company in the country to successfully implant a brain-machine interface into a human.

Doctors at New York's Mount Sinai West Medical Center implanted a Stentrode device into the motor cortex of a patient who agreed to take part in the COMMAND experiment sponsored by Synchron. Its purpose is to evaluate the usefulness and safety of brain-computer interfaces in enabling people suffering from severe paralysis to control the device without using their hands.

Ideally, Stentrode's technology should enable these people to self-send emails, text messages, and perform other digital tasks that healthy people take for granted.

Surgeons installed the implant through an endovascular procedure that avoided major open-brain surgery by inserting it through the jugular vein. The operation went "extremely well" and, according to Synchron, the patient was able to return home within 48 hours. The ongoing experiment in Australia is also going well, with four patients who received implants a year ago doing well.

It is clear that by the time when doctors can offer the installation of Synchron brain-computer interfaces to all patients in need, a lot of time will pass.

In July 2021, the company received approval from the US Food and Drug Administration (FDA) to perform an interface implantation operation in humans under the COMMAND pilot program, which is still active at the time of this writing.

The US procedure was a significant step forward. It will allow people suffering from paralysis to regain the ability to independently control their lives. It also testifies to the victory of Synchron in the competition - Elon Musk, for example, has not yet received FDA approval for the use of implants developed by his company.
